Thanks Bcohen. With no gap insurance and 4, 5 years left on the notes, I think that sounds like the smart route.

    Reaffirm with Honda Finance?

I have two vehicle loans with Honda Finance. Called them and was connected to bankruptcy department. Had a couple months of arrears to settle on one of the vehicles, and was prompted to call since they filed a relief from stay motion.

Was as surprised to hear from the representative that...

    No.

A preferential transfer is a payment you make to a creditor within 90 days of filing your case. You can do what you want and pay what you want to whom you want, but if you make a large lump-sum payment to an unsecured creditor, the case trustee has the power to take that lump sum...

Borrowed money that you paid back is not income. A friend of mine loaned me a total of 40k during my 6 month-CMI lookback. If it was a gift, that gets trickier. It could be seen as income, especially if it was a recurring gift. In order to structure it as a loan and not a gift, I put the 40k...

I am very happy for you! You sure seemed to approach this in a responsible manner crossing...

  • I had to familiarize myself with a carve out. I am so glad I didn’t know about this before because I doubt I would have slept. The debtor in these situations probably sees all their equity lost in a short sale, and the lien holder cooperates directly for a myriad of reasons. I found this link explaining...

  • If this goes forward, you might ask your lawyer about filing a Ch 13 to get caught up on the arrears and save your home. You have your discharge from the Ch 7. Whether it’s possible to file a 13 before your 7 is closed, I dunno....

  • A list of people from the trustee. Sounds like quite a relationship. So it sounds like a trustee can just do what they want with your house, even if selling it gives no money to creditors?

  • Oh my God what a joke. The trustee sounds evil. Kickbacks to a trustee to short sell a home that has only exempted equity? How does that fly? I had my 341 and my attorney checked we intended to keep our home here in Texas. We are 6 months in arrears on the PITI/ mortgage, and my income on my...
