    How to Not Include a Landlord in Filing

    I talked with an attorney who said that I don't have to involve my landlord in my filing because I'm month to month with no formal lease contract. I just don't know how to do this. Does anyone have experience with this?

    Yes, I have experience. You just don't list them on the Schedules (including Schedule G for Executory Contracts and Leases). Since you are month to month, you do not have an "unexpired" lease, so you don't need to list it on that Schedule G. If you are not in the middle of an eviction, you also do not need to list the landlord on Official Form B1 (the actual pages of the petition itself) where it asks you to list any landlord actions that are pending. You also would not put the landlord's name and address on the "mailing matrix" so that they do not receive copies of any court documents.

    That simple. You literally do nothing.
