    I have been summoned

    I am scared. I have no income besides unemployment. Do I go to court or do I let them win by default?

    PLEASE, answer the summons. Need more info to aid you. A Judgment is a difficult chain and ball. 'Hub

      You don't want to let them win by default. Either answer the complaint or file bk before the due date on the summons.

      Answer some questions here:

      What do you have in the way of assets? Cash, house, car, bank accounts, everything you own?

      What debt do you have and for how much?

      What is this particular debt for?

        I have no cash.

        The non exempt assets I have are a 2nd house that I am trying to sell and a camper.

        The past due debts I have are all credit cards. (5 or 6) totalling almost $40,000.00

            There's no good short answer to that. You assert your affirmative defenses and then answer the complaint paragraph by paragraph with admissions or denials. Ideally, retain a bk lawyer if that's the route you're going to go.

              I have about six other cards I am waiting to sue me. I am not in the position to file yet. I have a 2nd house to sell ( gutted and needs fixed first, divorce papers say i must make payments. House is worth $20,000.00 less then I owe in its condition) and a camper to sell. I want to wait until all cards sue to file. Is this smart or dumb of me?
