    Divorce question

    Husband & I are getting a divorce due to all this financial stuff The house is in both of our names but he is getting it in the divorce. However, the kids and I are staying in the home b/c its whats best for the kids. I am signing over the deed to him but the loan will still be in both our names until he can refi. Will the house be ok in the bankruptcy? Also, he's getting his car and I get mine but his is paid off. I'm getting off that title too. Will this be a problem in bankruptcy since the title change will be recent? I just want a divorce, to file and move on with my life

    I am so sorry about your divorce over money. That being said, most divorces are over this situation. IS IT POSSIBLE, if you get out from under, the marriage could be recovered??? If not, I would suggest, divorce first, get a good lawyer and make an agreement before you put it in stone on a bk. After doing that, you will be on your own and go from there.

    Again I feel badly for this situation, but as a divorcee, I cannot judge. Do what you have to do and if the marriage is broken, pick up your pieces and start a new life. GBWY. ‘Hub

        If you are actually going to get divorced and have discussed all this, for your own protection get yourself to a divorce attorney right away before any BK process is started.

          I have spoken to my atty and he said as soon as the divorce is final, that I can file Ch. 7. In New Mexico, it doesn't take long to get a divorce.......no waiting period. Its a sad situation:-(

            Divorce was inevitable. We almost divorced a year ago for financial and other reasons. Guess the time has finally come No repairing things at this point...........too much water under the bridge. I just need to move on and get my life together

              I have a question. Is there any equity in the house. If so is he going to pay you for that?

                There is some equity but he had the house before we were married so he's getting it in the divorce.
