The more I do the numbers, the more I think we will have to wait 6 months to claim bankruptcy. Hubby had a VERY unusual month of May. And we would have to wait 6 months for that to drop off. We are still looking for an attorney. I have to save for an attorney. Hoping we find one that will be understanding to our situation, not like the other idiot.

We are opening up a new account at wachovia tomorrow. We are also going grocery shopping. I have been absolutely petrified to spend any money since we came to the conclusion of bankruptcy. Tomorrow is also my son's birthday.

Calls are coming in all day long, I let the machine pick them up , ringer is off and I have caller ID.

I am just wondering is it normal to wait 6 months to file? or will the attorney when we find one, frown on that? I told my husband I am worried about us getting sued while we are waiting. We don't want o lose our house or car as we are current on those.

I have been doing better. I have been eating small meals and keeping them down. Haven't cried half as much. But I am still scared out of my mind.

Some of the credit cards may be 8 months unpaid if we wait the 6 months.

We have waited 6 months due to some cc usage and other things. We hired our attorney is Feb quit paying cards in Jan. We made the decision in Jan. We didn't think it would drag out this long, but it has. We actually hope to file this month towards the end or no later then July. Our attorney saw no problem with this. Once we paid our attorney in full, we gave all collection calls his name and number. Phone calls basically stopped once we did this.

We too are current on our house and intend to keep them, very little equity, but we need a place to live and in our area our house payment isn't much more then rent would be. Basically I would interview a few attorneys, find the one you want, and make payments to them. Make it your main priority to pay off the attorney.

We have very little equity in the house as well. I am just hoping that I can find a good attorney and save up enough to pay him!

I am also worried as our debt is all unsecured debt. 94K credit cards. I am so worried it will go over 100K in six months!

Plus the sueing and such UGH!!!

I found my attorney at the end of February and I am not filing until sometime this month.

I paid my attorney in full in March. He started taking calls, after I paid the retaining fee(in Feb.).

All our debt is unsecured. I take it you met with one attorney and didn't like him? Find another. Best bet is to find one your comfortable with who will help you know when to file. He/She can look over you situation and give you a time frame on filing and what to do to prepare.

When we made the decision to file, we quit using cc, this put over 6 months without charging. Also we quit paying. We wanted plenty of space between any cc usage and none of ours was questionable for the most part, no cash advances, balance transfers.... I really think your best bet is to find an attorney now. The cost could be high and it may take you awhile to pay them off and file.

An attorney can give you the best legal advice and don't be scared because your first meeting didn't go well, the next attorney, or even the one after that be able to answer all your questions. Ignore the calls for now, but once the attorney is paid, forward all calls to them, and make sure you ask the attorneys you meet with if they field all calls once you have paid them, some will even field the calls once you have retained them. This was important to us, very important. We had never been late and the thought of getting threatening calls just worried me to the point I was almost sick, I wanted an attorney who would take care of this for me. So far it is working like a dream, I don't feel sick when the phone rings.

Attorneys totally understand delays in filing. They often recommend it for success. It's their job to recommend the best timing of things. I met one attorney, whom I really liked, who said he has clients who have delayed for a year or more.

Crazy as it sounds, people have to get themselves into position to file for bk!

And from everything I've read on this board, it is definitely better to wait in most circumstances than it is to rush things. It lessens the chance we'll be accused of fraud--fraud in the civil legal sense, not in the felony legal way.

I'm going to have to wait 5 or 6 months to file due to some extra income in the first part of this year that is putting me above the median income. It stinks, but it's my only option.
