    Garnishement Hasn't Started Yet

    We filed a 13 on the 14th of October. We have already received the garnishment paperwork for my employer to start it. I just talked to my employer and they are not anticipating that the garnishment will start until the 18th of November because they haven't received any paperwork yet. We also received a letter from the trustee that stated they wanted the first payment by the 13th of November. Are they very flexible on this? Meaning, I know that I have to start keeping back money (saving) there's a word.... so we might have to make the first payment direct to them. Its not my fault it is taking this long to start garnishments and I also know its my ultimate responsibility. I do not know when our 341 meeting is going to be. Advice. please.

    I saved money out of each paycheck in order to be sure I had enough to make my 1st full payment to the Chap 13 trustee. In fact, the request to withhold wages from my pay was not sent to my employer until after my 1st payment to the trustee was due (30 days after the petition is filed). As far as flexibility goes...don't hang your hat on that! If at all possible, be prepared to make the payment to avoid any problems is my advice. Good Luck!

      The same thing happened to us. The trustee even made mention of it at our 341 meeting...how we are expected to make payments until garnishment kicked in. It was easier for us to send a check each time our paycheck came for the amount that would have been garnished. The trustee doesn't care how often you send payments, just as long as you send them!
