    Tax Forms?

    I can't afford an attorney, and am fairly intelligent, so I plan on filing Chapter 7 pro se as soon as I can save up the $300 for filing plus the credit counseling stuff.
    However, I see that you need a recent IRS tax form and proof of income. I have no income, and have not filed taxes since 1999 - have not needed to since then. I don't have any tax forms. What do I do in this case?

    I personally don't have a clue what you would do in this case. How you would go about proving you did not need to file income taxes. Unless you're an older person. Our attny asked for my Mom's income taxes from the last couple years and we told him she didn't file. Soc Sec Income only. Interest was not enough to require her to file. Attny said OK. Beyond that I don't know what to tell you.

    Just as an educational exercise for you,............. Call some BK attnys and schedule Consults. Consults are generally free and you can learn a lot. This would be one question to ask. As you do more research, you may have other Q's pop up that folks here don't have experience with.

      Definitely go see a few BK attorneys for some free consultation advice on this issue.

      If you didn't need to file taxes because you had no income since 1999, and yet you ran up credit cards without any ability to repay them during that time, then you might have a very difficult time getting those debts discharged because they might be considered to be fraud.

      If you can wait a few years before filing, you might be able get around this issue. Under the new BK laws, the trustee and the creditors can ask to see the previous 4 years of tax statements. And any years that have not been filed, must be filed before your BK case can be finished. If you can wait for 5 years before filing BK, they won't be able to ask to see the tax returns for the time period when the debt was incurred. Of course, during those 5 years you may be sued and have to deal with the consequences of a judgment which can be quite nasty unless you truly have no assets and no non-exempt income to garnish.

      Notice that I never actually mention or acknowledge the debt in my letter.

        You will need to be prepared to show how you did exist without any income and why you incurred bills if you did not have any means to pay.

        Maybe if you give more details on your situation we can provide some advice.
