    Need answers concerning IIB on CR

    Hi everyone,

    I know it's been a while but I've been spending my time between this forum, myfico forum and fulltime student. At any rate I hope everyone is doing fine cleaning their credit up. Anyway here's my dilemma that I thought you guys might be able to help.

    My bk discharged 8/14/2007 and closed 8/15/2007. I moved from my house in January 2007 as I had no intentions of trying to stay although I was just served foreclosure paperwork last month 9/29/2007. My question is all 3 CR's had been reporting IIB for my mortage and now CW shows back up on all three showing late payments of over $7K and the balance of the mortgage. yes the did an automatic lift of the stay but my scores are taking a dive and all my work of rebuilding them seem to be for nothing. I'm of course disputing for the uptenth time with all 3 and I'm mailing out my Schedule F showing CW IIB. Is this legal? Will they now change my CR's to show foreclosure and if so why did I even bother with all the scorewatch and disputing?!! you guys who know cindylynnsmith, and all the other regulars help me out here cause I'm really feeling bad. I had managed to get 3 cc's with decent cl's what do I do to keep my scores from going all the way back down. I'm really getting tired of playing this back and forth game with the CRA's

    Ok, first of all, did you re-affirm the mortgage?

    We need to know this before we go any further.

      I did not reaffirm, i gave the house up and it shows on all my paperwork IIB. I'm not sure whats going on since my lawyer won't talk now that my bk is discharged and closed. What's going on? Is it because they are not finally foreclosing that this is happening? I'm confused they were IIB and I moved out in January, filed in May and like I said discharged and closed in August. I was never even served until 9/29 and was told then it was just a formaility. Should I call my lawyer? Help, I still have the paperwork I was served but it just showed the original mortgage paperwork nothing new and by then my case was already closed?! Any help would be appreciated.

        My guess is CW is prepping to report the Foreclosure on your Credit Reports. But that's just a guess. A form of reaging the acct.

        People over at Credit Boards,........ Old Law filers,......... Had really good luck cleaning up their Credit Reports. Even getting accts completely dropped off.

        We had a couple drop off as if they never existed. Citi went back to the month of the last payment we made and marked our acct as Closed, Paid in Full. Totally took off the Lates.

        Others, instead of reporting IIB are showing "Charged Off. Bad Debt." Which they weren't. We didn't have any charge offs prior to filing.

        Advise I've read is to not send your BK paperwork to the Credit Reporting Agencies. But I'm beginning to believe that's gonna be the only way to clean up our reports effectively.

          Hi Sara (almost called you Missy again, ha ha).

          If I understand your situation, you filed BEFORE the foreclosure occurred, right? Therefore, the creditor should NOT be mentioning foreclosure or any late payments on your credit.

          If you want, PM me with the timeline of your bk vs. the foreclosure, when you stopped paying your mtg and exactly what it says on your credit report for this item.

          Of course, you can put it here too, but the credit report detail could get quite long as you know.....

          What you say does not sound correct and should be disputed. But I would not send them any bk schedules. I have heard some horror stories like many positive tradelines being deleted, and other bad bad things happening from sending any bk papers to the cra's.

              Thanks everyone for all your responses. All three CRA's changed it back to IIB. I decided NOT to send them a copy of my BK schedule or anything else other than disputes. So far my scores haven't rebounded but I'm hoping they all will in a few days. This is very tiring. It seems like I get a few points up on my fico scores only for them to drop again. I'm going to continue to fight but I must admit I'm getting really worn down by it all and very disappointed. I know it's only been a few months and I need to give it more time but starting over is way more harder than I thought it would be. I sure hope in 6 to 8 months my scores look better than what they are right now. Thanks for all your encouraging words and post on this situation. I guess sometimes I'm just ready to be where catchmeifyoucan, cindylynnsmith, and others are but I know it will take time.....and paitence something I strive for each day!!! I really thought the worse was over but sometimes it feels as if it's just beginning. Boscoe thanks for your support in both post, I decided to stop obsessing over my scores and just give it a minute. Hopefully after 6 months they will all improve as I pay everything on time and NOT apply for any more credit even though it's very tempting.

              highest scores 10/22/07
              TU: 498 - 10/12/07
              EX: 500 - constantly haven't changed
              EQ: 541 - 9/22/07 and from there it's went down with back and forth wrong reporting on my CR's from CW

              Having a score higher and being paitence about getting there.....priceless!
