I filed BK in 12/03 and was discharged in 3/04. When I pulled my report, Bank of America is listed as debt included in or discharged Ch7 bankruptcy. However, they reported from June 06-Oct 06 as CO. Can they do that since they were included in 12/03? It is on my Experian report. Also, my JCP card has debt included in or discharged but has a CO on 12/03. Is it okay for debts included in or discharged through BK to report high balances? Can that hurt a person's score?

If the account was not CO before you filed, and was included in your BK, dispute it with the credit bureaus. Include a copy of your discharge and a copy of your creditor matrix with your letter. Highlight the names of these two creditors on the matrix. They should be corrected to show 'included in BK' or 'discharged Ch. 7'.
As for the high balances, it is legal. They can show what your high balance was...but they are not supposed to show any current balances.

Hi, my husband and I filed bk 7 back in 2005 and Gemb/Sams club and Walmart keep coming back as a included in bk and also a charge off. Which both of these accounts have never been late. My husband had is removed for awhile on his experian (only showing up on Experian others ok) But now it came back as a charge off again..
We have spoken with both Walmart and they said the would take care of it. We have also written to them by mail as well as faxed documentation over to them that it should not be reporting as a charge off.... WTH.
Any suggestions how we can get this removed for good and have it just saying discharged and included in Bk

I was awaiting my investigation after disputing the 5 consecutive CO's that were first being reported in MAY 06 from Bank of America. GOOD news: they were deleted (CO's from June-Oct 06). Now it reports...date reported 12/03 instead of 5/06. All I did was dispute online with Experian.
Has anyone else noticed a big gap with Equifax scores compared to the others?

What you are encountering is quite common and something we have been having issues with for almost two years after discharge. We have cleaned up reports and then get all three again several months or a year later and lo and behold, all the old information we cleaned up is back again along with "Date First Major Deliquency was First Repoerted" colums filled with dates past our discharge date on several creditors we included in our BK. Equifax is the culprit with those listings and disputes just keep coming back as being verified so we have had to send out letters to all those creditors (I also copied Equifax on all those letters) and we are awaiting the outcome.
In your situation, continue to obtain your credit reports but wait 2 to 3 months between getting each because it takes a while for updated information to get on there. If they do not change the information, continue to dispute it; write directly to the creditor (obtain their BK account dept. - they all have one) and copy the CRA. Continue to do so until it is resolved. We spent many months with one creditor and they finally contacted us that they changed it with TransUnion (TransUnion was always telling us it was verified with the creditor) and TransUnion eventually sent us the credit report showing the correction. I am not going to get reports until until this time next year as our BK will be coming off as of 4/09. I am tired of fighting to clear all this up and it just appears again so we will fight again if necessary to just get the BK creditors removed if they are still on there as of 5/09.
Best of luck to you - just keep disputing, that is all you can do. Keep contacting the creditor and CRA and enclosing copies of any documentation you think may help (Discharge, etc.)._________________________________________

After I thought things were cleared up, guess what??? First date of major delinquency is reported as of 4/08...although the account in question was part of my ch7 BK, discharged 3/04. This was one I disputed with the CO's reporting from June 06-Oct. 06. Just when my credit score was starting to climb, Equifax nails me--dropping my score by almost 50 points simply by reporting false info. I have already disputed with Equifax about the major delinquency...hoping this gets cleared up. GEEZ!!!!!!!!!! Just when you think things are looking up, they screw you...and it's their fault!!!!!!!!

This appears to be an issue just with Equifax and the "First Date Major Delinquency First Reported" dates showing up. It is only with certain accounts and not all accounts discharged in your BK. I have contacted the creditors directly with copies of the page from Equifax showing this and have copied Equifax on all correspondence. Equifax previously advised all was being reported correctly. Thankfully, our BK accounts will start being removed as of next April and those accounts are listed as being in BK but showing the "Date of First Major Deliquency Reported" as way past the discharge date or within the year prior. This all must be something new going on because in past years when we checked our reports, those dates did not appear - it is only within the past several months.
