    Need help regarding medical bills post BK 7

    Hi everyone...

    I am new here and am just needing some advice. We filed BK 8/07. In July of 2007 we had some health issues with myself and our son. We at the time did not know that insurance wouldn't cover our ER visit. So this debt was before the BK....when we filed we were unaware of it. So it was not included in our BK. It is now in collections. Our BK was discharged 12/07.

    My question is this....What can I do about it being in collections without having to pay it? I will pay it if that's the only option...but I just didn't know if there was a way to have it included in the BK.

    Please..any advice would help!

    Unless you made a typo, this was not post petition debt.
    Contact your lawyer. If you had a no asset bk, your district may consider the debt discharged anyway. The other option would be to reopen the bk and include this creditor.

      Correct...the medical visits were before we filed. We did have a no asset bk. Is it easiest to contact our lawyer...or to try and do it ourselves? We moved out of state the day after our court hearing. Our lawyer was no help at the time..so I'm going to guess he will continue to be no help now!

            Simply send them your discharge paperwork.

              Just to be clear....send them a COPY of your discharge paperwork

              Be sure to keep all original documents sent to you by the court and your trustee yourself in a safe place for many years to come in case collectors come after you for discharged debts. In some states depending on the type of debt, that could potentially happen for 10-15 years into the future.
