    Does it really make any difference

    Hello Everyone,

    It has taken me about three years to clean my credit report up and keep it that way, although some creditors seem they continually make mistakes in reporting that requires one to stay on top of things.

    Anyway what I am wondering about is that two of my chase accounts that were discharged in bankruptcy are reporting that they were charged off.

    My understanding of this is that once one files bankruptcy all reporting is to stop and if they charge the account off after bankruptcy then that should not be reported.

    I called an experian customer service rep and she said the creditors could report the charge off as long as it occures before the bankruptcy is discharged.

    This seems odd since if true means that continued deliquency after the bankruptcy petition would then seem to be fair game before the final discharge.

    But does any of this really matter. The chase accounts are reported included in bankrutpcy and I don`t see how this would affect my credit scores?

    Thoughts?

    Ideally once a bankruptcy is discharged the ONLY reference on any of those accounts should be "included in bankruptcy", and nothing else. No references to prior histories. Ideally!!!

      The Experian Customer Service Rep was correct - late payments or charge offs before filing can be and usually are reported. For the account itself after the date of filing, it should show as being included in bankruptcy and most include the date of filing and the Chapter filed. Amounts should be zero.

        Hello and thanks for the responses.

        All of my accounts were either current or 30 days deliquent at the time of the bankruptcy petition. I had to get the filing completed before the law changed.

        What the rep said was that if the charge offs occurred after the bankruptcy petiton was filed and before the bankruptcy was discharged, 2/06, Chase could report it.

        Doesn`t seem right to me.

          If you have any late payments, charged off or judgments before filing, they are allowed to be reported that way until the amount of time allowed to be on your reports.

          If the companies report anything other that IIBK after you file, they aren't following the laws of BK and you can dispute it.

            I also had this problem with Chase and US Bank.

            When I called and spoke with both companies, they told me that "charge off" means the same as "included in bankruptcy".....I have continually disputed all "charged off" items. I wasn't even LATE when I filed bankruptcy.

              A charge off isn't the same as IIBK. If they are reporting things wrong they have to either correct it or delete it. There are laws that say this and they can be fined for being idiots.
