Charge off and Derogatory and late #

Hi, my question is we filed chapter 7 back in Oct 05, had are 341 and should be discharged by end of this month. Anyways, I checked my husband and my credit report with Transunion and some accounts show 0 balance already however so show charge off's and Deorgatory on them. Can I legally dispute this since they should be added as part of the Bankrupcy or can they legally keep them showing this? Also my credit score was 637 and my husband was 605. Will the go up after discharged and things are fixed? Thank you..

You will have to wait till after your case is discharged and closed to see accurate reports on your credit report. Then if something is reported wrong you can dispute it.

Companies do not have to report included in BK till after discharge. And then they have 30-60 days to do that....

Pull a copy of your credit report and start looking for errors now.

You won't see much difference in your credit score until all things are reported correctly and you start having a new credit history.

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

My case was discharged in January after filing in October. Everything on my credit report looked ok except for 2 accounts. They were included in bankruptcy and showed me still owing $6,000 each. I wrote a letter to the credit bureaus disputing the accounts. I received a response today with a copy of my report. Citifinancial is all creared up, but RBS shows one account included in BK and another outstanding. I only had one account with them. How should I proceed?

      Thanks

Dispute again, be very clear on what is wrong. You can also write to the creditor directly. It may take a few times to get it right. If you wanted to go extreme, you could sue for the inaccuracies. Personally, I would not want to get into that - seems very complicated, and you have to put in time & money first.
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
