    Checking Account Problems....ChexSystem

    Hey guys!

    I just thought I would let all you guys that are in Chex Systems something that happened to me today... I don't know if it was a fluke, but it might be worth some of you guys calling the original bank to find out...

    I call US Bank today, because I had put a overdrawn checking into my bankruptcy, and it had already been charged off and to chexsystems. I thought I was on the black list for 5 years after that. Well, I called US Bank today to find out if there was anything I can do to get off the list. I had thought maybe offering to pay 1/2 of what I owed them and went down with the bankruptcy would have them report to Chexsystems as paid, because some banks will open a new account if everything on your report says paid...

    So, the lady answers the phone, I explain to her I had surgery in July, and my account overdrew while I was in the hospital, and I didn't have money to pay it because of hospital bills and no income. Then I told her I filed bankruptcy in October and included this account in my schedules. She confirmed she saw that this account was included in my Chapter 7. I then proceeded to ask about ChexSystems, and that at last check US Bank had reported me owing the money on their records. I asked if it would show as $0, since I am not liable for the debt.

    This is what she told me: "Oh, I just need to fill out a form and send it to Chex informing them that a Chapter 7 was filed on this account." I said, how long will that take and she said, "about 7 business days."...

    Right before we hung up, I asked her how it would read in ChexSystems for this account, because I am interested in opening an account with a bank..

    She said, "Nothing, the account will be deleted out of their database when they get my form..." I said, "You mean I won't have a record at all with Chexsystems?" She said, "Thats Correct..."

    So folks... Maybe call the bank that you got in trouble with and advise you filed on the debt and want it showed as $0, since you aren't liable any longer and see what they tell you? I will let you know in a few weeks if this was taken care of the way she said it would be. She seemed VERY confident in her answers, and did not hesitate a bit. It was like I was a normal routine call...

    I hope it really works like this, and I just wanted to share in case someone else might benefit... I was only hoping for it to show $0 which is my current liablity, but deletion is EVEN BETTER!!!

    Thanks for sharing that with us, this is a very good information if it works out.
    Do you know the name or number of this form she is talking about? Where did you get this form, from your bank or Chex system?

      I am assuming it is just an internal form that US bank had..

      I don't know... I will update as soon as I try to open an account...

        Well, I called US Bank back today to see if there was a way that I can verify that my account was deleted PRIOR to me walking into a bank and looking dumb and being denied an account...

        I spoke to a representative that gave me Chex Systems phone number... when I explained to him that the number only allows me to order a report and I cannot speak to anyone first hand, he placed me on hold and called Chex Systems himself.

        He came back to the phone and stated my request had been processed and the account was DELETED from Chex Systems on 3/30 (today)!!!

        Seriously, try it guys, call your old accounts you filed on and see what they say... (especially if it was US Bank, they were TOO nice to me).

        He even went on to say they have a 2nd chance program, and that everyone diserves multiple chances in life... I am a US BANK lover now!

            I'm still interested to know what form you gave to Chexsystem? Did you get this form from US Bank or Chex system mailed it to you?

              No, I didn't get anything in the mail, and I do not know exactly what form it was.

              But when I called US Bank, I advised them that I knew they had reported my account to Chex Systems, but I have now filed bankruptcy, and was inquiring as to whether that account would show as a Zero Balance like on my credit report.

              The lady said, no they needed to fill out a form there and send it to Chex to request deletion of the account.

              I also called Chex today at a number I could actually get a live person at... 1-800-513-7125 and spoke to someone and they stated that the account has been deleted as requested from the reporting institution (US BANK).

                Lol, I get it now, it's the bank that sent some kind of form to chex system, not you.

                I will call Washington Mutual today and see what they say.

                  Ok. So I found out a few months ago that I was in Chex Systems, and had no idea. It was on an account that I never used because I had another bank account that I maintained. I was worried because I needed to open another account for personal reasons, and was afraid to 'try' with Chex Systems lurking in the shadows. Well, I was able to open the account anyway, which was good. Anyway, after reading this thread, I thought I would give it a try with my Chex Systems problem. I called the bank the other day and was told that because the account was included in my BK-7, that it showed a ZERO balance (which is why I was able to open the other account). But I wanted more. I want the blemish removed. So I called the bank again today. I mentioned again that I included the account in my BK, and that it should be removed from Chex Systems. The person that I spoke to said she would send the 'form' to Chex Systems, and request that I be removed/deleted from their system. I hope so!!! I'll keep you guys informed once I find out for sure if I get deleted from Chex Systems. By the way, the bank (credit union) account that I opened the other day said that an account could be opened if someone is in Chex Systems. It just depends on why you were reported, and how long ago it was reported (reported in 2002). In my case it was Insufficient Funds (had an account that I had a payday loan on, and they kept trying to redeposit the check). Anyway, I'll keep all posted on my outcome. Hope I get removed from that blasted Chex Systems for my own sanity!!! Good Luck!!!

                    Awesome, that sounds like the same thing US BANK told me, and it took 2 days to get it done...

                    Call the number I listed in my post next week sometime and advise them that the bank told you they were going to delete the record, and ask for them to pull it up to see if it really is gone... You actually get a live person at Chex System with the number I posted up above...

                    Let us know next week when you call what Chex says...

                    They told me today that its deleted and will take 3-5 business days to update and then I can go open a bank account with NO Chex blemish!!!

                    I called first on 3/27, and already removed as of 3/30!

                      I called Washington Mutual, not the branch but the 800 number, and they told me not only they won't remove it they won't even contact chex system to make it 0 balance. Ouch!!! Good thing I had a second account with a credit union.

                        If the account was included in your bankruptcy, then it should be shown as a ZERO balance. You might want to recheck on that.

                          High- I am sorry to get your hopes up with this thread, I didn't know if my situation was unique or not, but I wanted to post it in hopes that others could do the same. It looks like it worked for one other so far...

                          Call back again and state very clearly that you included this account in a bankruptcy and it is discharged which means you are not personally liable for the debt. If they still fuss, ask them how it is legal for them to report out to a company that you owe funds that were discharged in the United States Bankruptcy Court...

                            I work at a bank so I can tell you what I know. The bank is not required to remove you from ChexSystems. Many do if you file for BK so it is worth asking...make sure you ask to talk to a Manager though because even if the bank's policy is no they can over ride it. Same with opening an account. It is up to individual bank policy...some will not open an account whether the $ are paid or not, some will open after a certain time frame. If you file BK the bank is required to show your ChexSystem balance as a 0. If Washington Mutual will not change it to 0 you can ask ChexSystems to submit a dispute to the bank...it does not cost anything and the bank has seven days to either change it or explain why they will not. A tip most banks don't have time to get to these requests...they only have seven days and if they do not respond your whole record is removed...so call ChexSystems and just say that you don't believe your record is correct (don't say anything about BK, just say the whole thing is wrong...banks make mistakes all the time)...chances are the bank will not respond and it will be deleted in seven days...if the bank does respond it does not hurt you, just means your record remains.

                              This is news to me, because I'm in Chex and was told without question, even if it's in BK and discharged it's staying. (Or if you pay it.)

                              Congrats, though, nonetheless.
                              I'm not a lawyer or legal expert, just offering advice on what I may have gone through and/or have knowledge of. Good luck!
