    Question about consolidated student loans

    Hello everyone,

    Okay, When I filed bankruptcy I had to include everything in my petition. Which meant I had to file current, religiously payed on time, student loans. "Just wanted yall to know that I was paying on time". Anyway, don't you know after I've been discharged, these fools have opened up another account in my name? The original account shows debt included or discharged through bankruptcy and the new account states the same thing but it also states that THIS student loan is deffered. My question is, "Has anyone ever had this happen to them? This is crazy. I was aware that most of the time it is very hard to be discharged of your student loan debts and, the amount that you owe would still be reported under the same account number right? Usually payments would resume once discharged. So, I just sent Experian a nice lil' dispute letter claiming I know nothing of this account and have never had an account with this establishment under this account number. Do you think this is the correct approach? Gurus or anyone that has experienced a similar problem what did you do? Or what would you do if you we're in my shoes? I'm Hot Yall, Ready to cut some throats!

    Note that I consolidated my loans and about every three year or so, they are sold to other lender. It was AZ Student Loans, then something else, then Sun Tech and now I pay to Citibank..could it be something like that?? Also, when in BK aren't the loans automatically deferred? Maybe the report is a couple of months behind....I dunno.....

      I have read other people say their student loans went into Forebearance during the BK. But you're the first person I've read that anything like this happened to.

      I think I'd take the technicality attack as well. Not my loan number, not my loan, take it off my credit report. Can't hurt to try and might even work. You never know.

      But as a CYA, check your BK paperwork and maybe even what's filed at the Court House to see if the Court did indeed discharge that debt. If they did, WooHoo!! for you! Otherwise, you'll still owe the bucks.

      You might also, on the QT, run this one by your attny. You don't want anything to screw with your BK. Like not getting Closed or having the case reopened later on a technicality.

        Hope all is well.

        Yelp, I checked pacer and in the lists of creditors that debts were ordered discharged, my student loan company was included. I never attempted to reaffirm the debt or anything nor was I persuaded by my attorney. I haven't communicated with the Student Loan Company since my last payment before I filed. The problem could be that the credit agency hasn't been informed of the discharge and all that yada yada. You think I should kinda chill till everything is updated as far as the closing and that my debts have been discharged? I have some disputing tactics up my sleeve but don't want too get too ugly at this point. Even though CRA are Evil.
