I have been in Chapter 13 now for 3yrs and would like ot sell my home. I have contacted my attorney twice regarding it and all I can get from him is that he wouldn't advise it. I know with the new bankruptcy laws that take affect in Sept, we won't be able to make any changes after that. Can I petition the trustee myself, or must it go thru our attorney? Will they take all the extra money over what we owe on the home? I am guessing we could make about $30,000 over what we owe if we could sell our home and that would be more than enough to pay off the other debts that were included. Can I visit another attorney to take over?

Thanks so much for responding.
Our plan is for 5 years. The area we live in is about 4 blocks from a major retailers corporate headquarters, and the land around us has been quickly changing over to business development. Today we were approached by a deveolper to trade our home straight across for a home in a neighboring town that is more than double our current homes square footage. But the past two times I have questioned our attorney about selling our home,all I can get from him is that he wouldn't advise it.
