    401K Question

    Are you allowed to contribute to your 401K while in chapter 13? I would hate to lose out on the company match.

    Should be able to. I did.

      If you can afford it.

      Contributions above and beyond the standard of living are not calculated into determining your disposable income. If you have anything left each month, you can put whatever you like into 401k.

        My 401k "expense" was allowed. I am doing 6% w/6% company match. It was not questioned.

          It may depend on your Trustee. Ours did not allow any 401K contributions unless the plan was 100%, which ours was not. However other trustees in our district do allow contributions. If your attorney is experienced, they would be able to tell you what your trustee normally requires.
