    Sell House immediately after Ch 7 Discharge

    Discharge date: June 6, 2005
    Equity exemption: $40,000
    Type: Chapter 7 no asset MI
    Do I have to contact Trustee prior to sale of home to get his permission to sell....even if I stay within my exemption allowance? If I must notify him, how long does it take for approval of this type (average) or does it "flag" my case for re-investigating? Am I opening up a whole new can of worms to sell?

    We want OUT NOW!! House is too expensive. What do we do?

    I am going to sell my house as soon as I get the discharge. It is already on the market. The trusteee didnt' mention to me anything about having to tell him if we sell our house, just if we were to get a large gift/inheritance/lottery in the next year. I know when someone close to me went thorugh this, they received a $15,000 settlement and it was never questioned. I would assume that if you are under your exemption amount, not to worry. At least I'm not going to. Just remember, they dont' put a lien on the title of your home and sometimes what somene doesn't know won't hurt them. This is just my opinion.

      There shouldn't be a problem if you sell your house after discharge. I suppose the only issue would be that if the house sold for substantially more than the value you listed on the BK petition and could not attribute the increase in value on market conditions between the date you filed and the date you sold.

      But I doubt you have anything to worry about, I don't think you have to report the sale the trustee.
