    Stressed No Longer Should be confirmed

    Well I just want to say thanks for all the Information within this web site. the trustee finally agreed to my terms with just a few little things i have to do for them. Well my Atty left the firm and the new guy i was assigned to my case he jumped right in and started reworking the numbers and this is what the time line looked like:
    March 26 The first 341 Meeting they wanted $480 per month and $1680 per month after my 401K loans were paided back. remeber this is with my old atty same firm.

    April 23 the Court Appearence With the new Atty, He said they are wanting the same terms. $480 per month and $1680 per month after my 401K loans were paided back. Also wants a quartly update with pay stubs with month to date on it, Tax returns and any other extra money that comes in.

    As of today I got a email from my atty and this is what he has got it to and should be confirmed on June 4:
    After negotiating with the Trustee, the trustee has tentatively agreed to a plan payment of $300 per month until the 401k loans are repaid, then starting 11/2010 stepping up to $1493. The Trustee would also require that I turn over taxrefunds during the plan, provide quarterly pay stubs and provide annual taxreturns, with a prorate increase in the plan payments if the income
    increases (or, for example if you start getting more overtime).

    I am really happy after all the stress. I have a total of 1 payment down 3 more i will turn over on the fourth. I think it will work it self out and the atty said if anything happens with work we can always convert it to a chapter 7 if needed to. Well wish me luck I will keep you all posted.

      May I ask what you are paying back in your plan? ie. taxes, home, credit cards...

      Is it typical for your trustee to want to look at peoples quaterly paystubbs? Was there an issue with your income that made the trustee request this?

        Yes there was a issue cause i was making alot of extra money with OT and now my company has starting to Down size and there is not OT or Shift dif available this brought down my income. So the trustee want to make sure im not trying to get by on them i think. Southern California is one of the toughtest i was told by my new atty. So i would not be to worried, it was just my circumstances that caused this to be requested. Good luck
