Hi everyone, I am so grateful to have found this forum after looking for something like this for quite a while. I reluctantly filed chapter 13 back in April. I had started a business last year and heavily relied on credit while trying to build my business. Unfortunately my business did not work out and I had to close it down. Currently I am looking for a job and am concerned about if I should disclose my bk in the interview. I am married and my husband does have income which is what was used when we filed the petition. I filed by myself as the debts are all mine. My attorney assured me that employers do not look at credit but I am not so sure that is true. My attorney also told me that when I do get a job I can continue to make direct payments as opposed to having my wages garnished. My confirmation hearing is coming up and I am getting really worried. Any thoughts on this would be appreciated.

Question about interviewing for jobs and disclosure

Do a search in this forum for many recent postings related to your inquiry. During your interview, it is not necessary for you to disclose anything you are not asked for; however, if on your job application which you will either submit at the interview or have already sent it in, you may be asked "Have you ever filed for bankruptcy?" If you answer no, and you did, and when they run a background/credit check (just assume they will do both - most employers do nowadays for many various policy, insurance and legal reasons), they don't have to consider hiring you. If they don't ask, as HHM stated, you don't have to tell. However, please be aware that when you sign your job application, there is wording in there that will allow them to check your credit, do a background check, etc., etc. Prior to hiring or during the interview process, they will probably advise you also that any job offering would be contigent upon passing a background check or credit check (if the job is financial in nature, or involves the handling of cash or other peoples' accounts at a bank or financial institution), if there is BK on your records (if you filed in April there probably is), you may not be considered for the job. At this point I would face that dragon when/if it rears its ugly head for for an intial interview, there is no reason to bring it up unless asked. Just make sure if that question is on your job application that you answer "yes." If asked during the interview, explain it was a bad time due to job loss, medical emergency, etc., etc. and that you are on the road to recovery and it will not affect your performance in any way at a new job._________________________________________
