    New child in family

    Hi, I filed chapter 13 in March of this year. My wife and I are thinking about another child. We are a family of 3 right now. We are borderline over the median.

    So my question is this, if we have another child during the chapter 13, do I 'amend' my case and have the lawyer re-do my expenses? What if this puts us under the median for a family of 4, can we convert to a chapter 7?

    We are just considering the consequences right now, any help would be appreciated!

    I am curious about this myself - I had a baby right around the time I filed but when we did the budget it was based on family of 4. We are getting by ok with our expenses but I'd be interested in any response to others situations.

      Any time another person is added to your household your expense change and your Chapter 13 needs to be amended to allow for the expense. (babies sure aren't FREE and the upkeep is sure not free....)

      Anytime you have a new addition, notify your Chapter 13 attorney or Trustee and let them know.

        I asked my attorney about this because we would like to have a child during our 5 year plan. He said that we could have it amended, but that they would do a complete relook at our income and expenses. No problem if nothing's changed tremendously since you filed. He did say there would be an extra fee.
