    My 341 is Tomorrow

    I am very nervous. I know everyone says it's a breeze and they can't belive how much they worried, but I can't help it. It's going to be an all day thing tomorrow. I have to be there at 8:30 am to complete my second part of counseling. Apparently in my district they do this with every 341. So I guess it's one less thing when I make it to the end of the plan. Then the 341 hearings start at 8:30. I am bringing all my paperwork with me, even though my attorney says he has sent everything beforehand. I just want to make sure.

    I have been having the craziest dreams about it!! I know it's just begun because it's after the 341 where I really start stressing, hoping my plan's confirmed.

    when they hook you up to the lie detector machine becareful to think each answer out. The voltage for wrong answers increases as lies are told.
    The fbi will give you a needle of truth syrum and will take a dna sample.
    You will be laughing on the way out wondering wht you were worried about.

        yes everything will be just fine,it all seems like a pretty hard thing to do and it is. but you will get through just fine. remember,what dont kill you will only make you stronger. best of luck and God Bless you man.

          ok, Just got back from the long session and 341 hearing. The trustee didn't like my proposed amount and suggested to my attorney that he needed to update some expenses. It was very stressful. I was proud of myself for not crying. I wasn't expecting to hear right then that he had issues with my plan. He said it wasn't enough to pay pack to my unsecured and pay his fees.

          When I left the room with my attorney, I broke down. Attorney says when can submit an amended plan once he finds out what the actual abjections are or wait to the confirmation hearing on the 30th and plead our case with the judge.

          I'm not sure what to do. I really want to get it over with.

            I'm sorry to hear that your 341 meeting wasn't as smooth as hoped for.

            However, I understand that it's rare that any bankruptcy filing gets confirmed without some objections from the trustee. Most objections aren't deal-breakers though and it sounds like you have a good attorney with you so try to relax and not stress over it so much.

            My confirmation was delayed a month because of objections from the trustee but they were taken care of. It was very stressful to me so I know what you're going through right now.

            When the trustee has filed his objections, you'll receive a copy in the mail and it will state exactly what his objections are. Your attorney will receive a copy the same-day probably so he'll work towards resolving it for you.

            Although my trustee didn't object at my 341 meeting - I freaked out when I received his objection in the mail. But when my attorney explained that there are almost always objections and that they would take care of it - I calmed down over it and just waited.

            I'm seven-months into my 60-month payment plan and I want this over with as well. But you just have to be patient.

              Hi Chloe,

              I am sooo sorry that your 341 meeting didn't go well. Does your attorney have any idea what objections he "thinks" the trustee is objecting to? Are you monthly bills that high?
              We are in the same boat, I am currently filling out my "expenses" and I am REALLY afraid the trustee will object to a lot of the items and leave us with NOTHING!!!

              RE: Busby, what was your trustee objecting to? When you re did the budget, did you have to cut a lot of expenses out?

                Thanks for the support.

                Liz - my highest expenses are for medical. My husband has a heart condition and even with our insurance, our out of pocket costs are through the roof monthly. He did ask me if someone in my family had a medical condition because of how high they were.

                I do feel like he was trying to be helpful. There were some small errors on my paperwork becuase of sematics. My attorney and him kind of joked about it because apparently he had filled this part out wrong before with another client. It didn't seem like a big deal. The one think he did mention was that the my percentage of payback is only 10% and that didn't allow for him to get his portion. I hope it just takes a few adjustments and then we're done.

                What made it more stressful was my husband's reaction yesterday. He is not filing (we are trying to keep one persons credit in tact and all the credit cards are in my name). He misunderstood what the 341 was and freaked when I told him there were objections and it was going to take longer. As if I needed more stress.

                Anyway, after a night to sleep on it, I'm feeling better. As I told my husband, even if we have a little higher payment than what we propsed, we are still way better off than before we filed.

                    my 341 was in March and I am still waiting for confirmation.... my meeting was a bit rough - I felt like I got drilled with questions I wasn't prepared for. I work for myself so that was most of it. I broke down too.... as soon as I got to the car! Now just to be confirmed would ease my mind a bit - but all in all its been a positive.

                      The trustee didn't object to my budget - I needed to submit proof of insurance before he would recommend confirmation. I'm self-employed with employees so I needed workman's comp and general liability insurance.

                      The budget wasn't a problem for me.
