YEAH! Our 36 months are up. Our NDC shows completed. We had paid in too much through payroll deduction and I just received the check today from the trustee for that. I do not have the discharge papers yet, but I am assuming if I received my refund of overpayment...all is well. There is still one if not two more weekly payrolls that they havent received yet that they will have to reimburse me on as well. My question is this: Our second mortgage was included in our BK so who is to inform that company to release the lein? Do I call them to do that or do they automatically know to do that? It has already been filed at the court way back when we first filed our BK. Any thoughts would be great! I AM SOOOOOOO EXCITED!!!!!! For everyone out there going through this, there is light at the end of the tunnel.

Congratulations.
My last payment just went to the trustee on the 1st. I have canceled my automatic payment from my checking account (I'm retired, so that's how they had let me pay). I'm not about to make another payment. It says what I had to pay, which equals the amount they show I have paid. So that's that. My first and second mortgage payments were made outside bankruptcy, so I guess all I have to wait for is a discharge from the court?
In answer to your question, I believe the court notifies all parties that the bankruptcy has been completed successfully.

CONGRATULATIONS!!! I've read that the notifications regarding the end of a 13 is different from a 'discharge' as in a 7. But the light at the end of the tunnel has arrived!!
You made it!!

make sure you receive your letter from the trustee's office to stop making the payments. Don't just go by the 13 data center. Or call the trustee to make sure you are done. Unless you get the letter stating that payments can be stopped, I would keep paying. But congratulations. I am right behind you.

Well, I didn't have a second mortgage, but I did have a van that we were upside down on in mine. After the secured was paid, we started on the upside down part. When we closed, they sent the title within a month. I never called them or my lawyer about it.Originally posted by Bernie View PostMy question is this: Our second mortgage was included in our BK so who is to inform that company to release the lein? Leins though, I don't know about. If you used a lawyer, perhaps try calling them and see what you need to do.
Congrats on making it through. If you can do this, you can do anything.Chapter 13 filed -8/12/04

Emma, I would not quit making payments without the trustee telling me it was ok. They could still screw you up at this late stage of the game. If you have a pacer account, you can log on and see if the order is there, just hasn't made it to you yet.Originally posted by EmmaT View PostCongratulations.

Me too!!
I also had my final payment drafted on the 20th of October! I'm so excited to have made it through this...
I fully expect them to draft another payment next month, as my lawyers haven't managed to do anything since I gave them their payment. I'm sure that if I contact them and ask them to have the trustee do their audit, they will ask for more $$ to do the paperwork!! (Does anyone know if they can do that??)
Either way - I'm just glad that I made it...

PS - Hint for others - AUTO drafting the payments is the way to go... you never have to worry about missing a payment - or forgetting to mail it. I just dropped 1/4 of the amount into an account every friday - and then it was there. What I didn't have in my account - I couldn't spend! That was never "my" money - it was alway the trustee's money!
