    thinking of waiting it out

    Since we had a BK 3 years ago, we will need to do 100% payback. Also we bought our car just a little over 2 years ago. So we have to pay that 100% also. If we wait until July our 4 years will be up. So I have a question. If we wait, would we still end up paying 100% of everything back? We own NO house or real property to speak of.
    Filed August 09, all payments made as of July 12th, 2013.....Waiting on final audit and discharge!

    you would probably pay less than 100 percent if the 4 years since discharge has passed depending on your finances and your plan, of course. If you can, I would wait.

      Where are you getting "4 years"? Was that from filing or discharge? The rules are different depending on whether it was a 7 or 13 but I haven't seen anything allowing another BK in less than 6

        I belive the OP filed a chapter 7 and now needs to file a chapter 13. In that case, no discharge can be granted in a chapter 13 unless 4 years has passed since the last discharge was granted. This was inserted in 2005 to stop the chapter 20 filings where people would file a chapter 7 and wipe out all unsecured debt and then when discharge, file a chapter 13 immediately to catch up on the house or other debt not discharged in the chapter 7.
