    How is trustee % factored into the plan

    Wanted to get other CH13 bk'ers experience on this.

    If my total claims are 104K (this is the plan total and includes 30% payback to unsecured), and the trustee fee is 10%, does that mean I must payback 114K+ over the 5 years? Or does the 10% due the trustee get 'drained' from the creditors and I really only have to pay 104k? I guess what I'm really asking is if the part of your Ch13 plan where it says funding of the plan, is that amount supposed to include the % the trustee is supposed to get over the life of the plan?

    Jan 2010: Plan Amended and Confirmed! finally plan funds = total funds due!
    Jul 2013: 5 years done! Trustee set to discharge! Woo hoooo!

    When I filed it had a monthly amount I was supposed to pay based on how much disposable income I had (from the schedules you fill out). That determines how much is paid into the plan. Trustees fees can vary over the course of the plan, how many creditors file claims (and for what amounts) can vary from what you initially proposed, but in the end it all comes down to that montly payment. What was your monthly payment? Take that number and multiply it by 60, and that is the total amount you will be paying back in your plan. In the end my payback is actually going to be a little over 75% to unsecured because less filed claims than anticipated. In your case, maybe they filed for more (tacked on interest and penalties you didn't know about when you filed) and so your base plan is larger than expected. But I think if you make the montly payments you proposed intitially, you are fine, that is how much you will pay back, forget the percentages.

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!
