    Hmm..I have been getting calls from Macys 3 or more times a day and I finally called the bankruptcy department to tell them I am filing. Was that the wrong move??? they wre the only people calling and they were driving me crazy. It is the 7 nov and I plan on filing Ch. 13 3 Dec---do you think they will send it to collections quick fast??? My account is only like 15 days late.

    You will get varying opinions on this from the members of this forum but my personal opinion is that you did the exact right thing. Whenever I had a creditor hounding me, I picked up the phone and let them know about the BK. The vast majority backed off. The couple that didn't at least slowed it down. Most of them were actually civil. Most.

    If you are sure that you are filing that soon, then yes, I believe it was the right thing to do. I wouldn't worry about the transfer to collections at this time. Those things take time, and even if you do get contacted by one, just tell them of the BK too. Chances are they will send your case right back to the original creditor claiming foul.

      I told my creditors that I was filing once I retained my attorney in mid May...I still haven't filed and my home phone hardly rings now (no lawsuits, judgements, etc.)
      May 2008 Hired 1st Attorney/Stopped paying CCs
      May 21, 2009 Retained 2nd Attorney
      May 28th - Filed for Ch 7 (FINALLY!)
      9/11/09 - DISCHARGED!!!!

        Creditors are told repeatedly by debtors who owe them that they are filing, even if they are not. You may see a decrease in the number of creditor calls, but creditors do not have to stop calling until they receive notice that you have actually filed.

        That said, it's impossible for a creditor to push through any kind of court action in 15 days. You don't have anything to worry about there.

        As creditors continue to call, if you choose to answer the phone, the only thing you have to do is identify yourself as the party they wish to reach, tell them you are unable to make a payment at this time, then hang up, even if they are still speaking. Don't let the bullying get to you and don't speak to them any further. You still have all the power in this situation if you just use it.

          There is absolutely no downside to talking to your creditors and letting them know what is going on.
