    341 done!

    We are just back from our 341 and I am so glad that is done and over with.
    Ours was scheduled for 11. We were 3rd called up. Here is what we were asked:
    State your name and address
    Did you read and sign your petition
    Did you list all assets
    Did you list all debts
    Are you aware you have to make monthly payments
    Have you come into any money like lottery winnings

    Done! All he wanted was our ss cards and license. It was painless but I was so nervous.
    The other cases were very interesting too, We got there about 20 min before it started.
    I am so glad that's done!

      Skiping a payment

      Just had 341 meeting and have made two payments. now my husband has to have knee surgery. He will be off work with no pay for two months. Does anyone know if they will let you skip a payment and add it at the end?

      I asked my lawyer and he said just miss it and catch it up later down the line.Do I need to speak to the trustee to confirm this or will the lawyer?

      Our lawyer has messed so many things up and I do not have alot of confidence in him. We have 5 objections, one being him overcharging us!!!!!

      I thank god for this forum, because everyone shares so much useful information.

        Write a letter to the trustee and explain the situation. You might want to call the trustee's office too, though most likely you will be told that they can't speak to you because you are represented. But explain as best you can.

        Also with the letter, send it certified with return receipt and keep all your receipts for your file. Also send a copy to your attorney. You don't have certify that. You may get taken to task for going over the attorney's head, but you want to cover as many bases as you can. Remember, your attorney is YOUR employee.

            I would definitely try to send in "something" instead of not making any payment at all. Plus most trustee's dismiss after 2 missed payments, so try to maybe only be 1 behind for a minute. It will be tough to catch up because it will mean "double payments" for a couple of months to do it. So if you could scrimp on something else to keep up, I think in the long run you would be better off.
