    question about discharge

    So, technically we made our 36th and final payment in October. They are obviously still taking $ out of my husband's check. When does this stop? How long is the discharge process? What happens during discharge? We see from data center that we a -$340... I assume we get this back eventually? How much longer is this torture going to last? We are practically right there... finally!

    For me, we made last payment in August, stop pay order in Sept, auditing in Oct and discharge in November. It really was painless. We paid directly, so we didn't have any left over, but I have read where you will get it all back. Consider it savings for now!! Good luck and congratulations.

      When you made that last payment you should have contacted your attorney that you made the last payment and followed any instructions from him. The Trustee needs to stop the wage order for the funds being taken out of your husband's paycheck. The average time to obtain your discharge is about two to three months after your last payment, give or take. Your trustee may acknowledge your last payment with a letter and advise you of the steps that will be taken for your discharge.

        Thank you all. According to PACER, nothing has been sent or done yet. Last activity was in July (our attorney resigned - go figure). Money has been taking out of my husband's acct but I stopped sending payment (I manually pay a third of the monthly amount since I switched jobs and didn't ask my employer to deduct it from my account a year ago). The site says they owe us $340 and there is 0 months left, with last payments meant to creditors on 11/7. So I'm assuming we're almost there... I guess with the holidays coming up it's taking some time... Thanks

          I actually didn't call my attorney, but called the trustee's office instead. My payment was $557 and I only owed $137 that month, so I called to ask which to send in. She told me the $137 and then I called and check with her the following month to see if I didn't need to pay, she said no and then she sent a stop pay order. My stop pay order never showed up on Pacer. I was really lucky, the women that was assigned my case has always been very helpful.

            So I guess it wouldn't help to contact the Trustee and see what happens. I am so glad this is almost over... something to give thanks for on Thanksgiving!

              Definitely, either call or write the Trustee's office just to make sure that your case isn't buried. It usually takes a month or two for the withdrawals to stop on their own, but it wouldn't hurt to at least check in with them.
