Well, I'm self employed and will gross about $70K this year. I can pay myself about $1200/month. I have $18K in CC debt, $9700 in a truck loan. I'm doing a Ch13. My attorney figures that I can pay about $300/month and that's fine with me. I made my first payment yesterday and have my 341 on Jan 8th. My husband and I make 100k per yr. We have the following debts if we file:
unsecured:
9k cc
66k-will have to walk away from rental property
55-60k- will have to walk away from primary residence
45k- have to reject commercial lease
total about 180k
we'll move back to our 2nd rental property a condo so we can survive the chp 13.
Our attorney quoted us at paying 1050 a mo....doesn't this seem really low??
Our condo is only 846 but the allow is 1450 per mo so this is where he said we are really helping ourselves...

Hubby and I make around 65k a year and we have $74,00 home loan $ 20,00 car loan ( 2 cars) and about $15,000 in cc and unsecured loans. We are in a 5 year plan at 100% and our payments to trustee started out at $1,000 every 2 weeks but we had to modify this past summer and now payments are $800 every 2 weeks. Plus all income tax refunds over $500 and any bonus and profit sharing my hubby recieves. To me this sounds high as we were not behind on anything other then 1 or 2 unsecured loans. This is tough as I was laid off the end of Oct and son and wife and child moved in with us. So far we are making it ...just cant wait till this is over!! Trust me it ain't easy, especially at Christmas ( thank goodness for Kmart layaway) but you can do it! Hang in there and good luck!!

It doesnt matter what everyone else pays. You cant compare yourself to someone else, even if your income and every other indice matches. States differ, trustees differ, attorneys differ.......Filed: October 1, 2007 341: December 10, 2007

Exactly right. EVERY case is different, your income, expenses, debt, etc. The only way to find out what your payment would be in a Ch 13 is to complete the paperwork.Originally posted by MajorMike View PostIt doesnt matter what everyone else pays.
