So I looked on pacer today and see that my mortgage company filed a claim -- i am paying them outside the plan and am current on payments (never been late). I noticed that they also want 350.00 for filing the claim. Do I need to be concerned about this?? I dont understand why they filed the claim?? Any help would be great!

Bring it to the attention of your attorney. What they are doing is charging you fees for the extra paperwork they will incur as to your BK and moving your account to their BK Dept. Our mtg co did the same thing yours has done, and then some. They actually filed a claim for the legal fees, showing it as an arrearage. Then our trustee objects to confirmation because we are paying the mtg outside the plan and supposedly behind. It took a year of going back and forth, canceled hearings, etc to finally get it straightened out. But that claim for the legal fees just sat there and was not paid out of my 13 funds.
So hold out hope, but I agree with the others, in the long range 350 isn't that much if you do have to pay it.Chapter 13 filed -8/12/04
