mortgage company filed claim--paid outside

    mortgage company filed claim--paid outside

    So I looked on pacer today and see that my mortgage company filed a claim -- i am paying them outside the plan and am current on payments (never been late). I noticed that they also want 350.00 for filing the claim. Do I need to be concerned about this?? I dont understand why they filed the claim?? Any help would be great!

    My mortgage company filed a calim as well. I think they have to show as filed even if you pay them outside the plan.

      Correct, they need to file a claim regardless of how they are paid. Nothing to worry about.

        well I am ticked off because along with them filing I am now responsible for another 350.00 -- I guess I have to pay that???

          I'm not sure what that's all about, but in the whole scheme of things, 350 is not much and will be paid through your plan.

            Same situation here. GMAC mortgage charged me a $175 fee. They haven't really attempted to make me pay it, but it is a line item on my statement every month.

              Bring it to the attention of your attorney. What they are doing is charging you fees for the extra paperwork they will incur as to your BK and moving your account to their BK Dept. Like it costs $350.....We did not have any charges like that and we paid outside our Plan.

                We didn't. ( unless they have secretly tacked it onto our principal, which honestly I would never notice anyway)

                Our mtg co did the same thing yours has done, and then some. They actually filed a claim for the legal fees, showing it as an arrearage. Then our trustee objects to confirmation because we are paying the mtg outside the plan and supposedly behind. It took a year of going back and forth, canceled hearings, etc to finally get it straightened out. But that claim for the legal fees just sat there and was not paid out of my 13 funds.

                So hold out hope, but I agree with the others, in the long range 350 isn't that much if you do have to pay it.
