Then go park it somewhere and leave. But then you'll be guilty of abandoning it...as the statue says. Look...you're the registered owner but you don't have free and clear title to it. So, you can't sell it or even dismantle it and sell the parts. And, if it's proven that you abandoned it then you can be fined. If you don't want the truck then turn it over to the trustee. sure, if i wanted to be an upstanding citizen then i would go to the ends of the earth to make sure they get the vehicle all safe and sound no matter what it cost me...yeah right!
i dont owe them fools anything...the trustee already said that they failed to recover the vehicle within 30 days so it is considered abandonded!
i just got the forms to file for abandonded vehicle and will proceed to acquire the full title...i will be glad to submit a copy of the title once i get it if it will satisfy any of you gurus
i cant seem to find a single person to get on board with me here...cant a guy get a little sympathy or something from this bb? you guys are tough!
i know whats coming next..

my post is about what are my rights if they lien holder fails to claim the vehicle..
all your saying is go to work for them for no pay and make sure they get on the ball?

it seems to me that there is some law somewhere that would explain what MY RIGHTS ARE..

i will trust the trustee who SAID they have 30 days to recover or they have ABANDONDED the vehicle..
i guess if it takes them 6 or 12 months to get around to trying to get the vehicle back then i am supposed to shut up and store it for them?

Hello Crawdad - I too do not sugar coat things as many posters can say on here and your posting brought up a good topic; however, it appears you have answered all your own questions with all your responses and own research as to your situation and will do what you want to do anyway. Since you state you live in Alaska, it may take some time for the creditor to come obtain the vehicle due to many folks having their vehicles repossessed in this economy or may not have an office in Alaska and would have to hire outside people to do it; or it is possible the expense may just outweigh the value of the car and they will not. Did you ever discuss this situation with the attorney who handled your BK? He/she can correctly advise you as to your rights in the state in which you reside as to this vehicle but remember you are the one who stopped payments on it which put you in breach of contract and then included it in your BK filing. And why don't you want to be an "upstanding citizen". The implication, of course, is that those who file for bankruptcy must not be good citizens. I was informed, implicitly, that I was persona non grata when I suggested here that perhaps we shouldn't be too proud of our circumstances.
You're pissin' into the wind, friend, no matter how clever you think you are. Most of us are here to make for ourselves a better future. Yea, okay. I would like to be the person at DMV when this genius walks in and tries to get a new title. Have you ever heard of a LIEN holder? I highly doubt DMV is going to hand you a new title when there is a lien on that car.
