    missed the 4/15 deadline

    I came to relieze that my wife and I misse the federal deadline for filing and took it to my attorny today who then faxed it to my trustee. what worries me is I read that is a reason for case dismissal....but I was only a few days late and the IRS owed me(if I wasn't going to lose the whole thing) any body have any experience in this area???

    Since you didn't file your tax return by the due date or did not send in a request for an extension, you will probably be subject to a penalty for not filing your tax return. Go to www.irs.gov and review the filing requirements for your federal tax return. What about your state? Was it due also on 4/15? Some states are due 4/30.

      You will probably be alright; it ultimately got to the trustee.

      Are you going to owe taxes (hopefully not if you are in an active 13, if you do owe, you need to adjust your withholding, or start making estimated tax payments), if you do not owe taxes, then at least on the IRS front, you don't have anything to worry about.

        The OP did state in their post that the IRS owed them money

          This is going into my second year of Chapt 13
          I filed extension on personal but got business
          filed in time..... I just got call from attorney
          no extensions are allowed in Chapt 13 and
          I basically got 2 weeks to finish personal taxes
          or be dismissed just my knowledge
          Started in Chapt 13 Switched to Chapt 7 Discharged 2009 Dec.........Filed New Chapt 13 in 2010 to deal with new surgery bill and stripped second mortgage! The story continues

            thx to all who replied...I am hoping that since I contacted my attorney and they faxed the return to my trustee that being 5 days late will not be a reason for the trustee to make a big deal...since I didn't owe the IRS I am not really worried about them although when I contacted the trustee's office the lady I spoke to said that it was the IRS who might dismiss the case which kinda confused me..what was the worst was my attorneys office complete lack of an answer all they would say is we just have to wait and see...hopefully when I send the check in a timely manner the whole thing will be fine

              I think if you file your taxes and rush a copy to the trustee and your attorney and the plan is going well otherwise I doubt you get booted!

                thx car67 with any luck you are right I am going to due my state taxes tonight and the state deadline isn't until May 17th
