    What is Pro-Rata percent??

    Hello, my payment plan base is 27k and it is paid back at 100%. I noticed on the form it says that general unsecured are paid back at pro-rata percent.
    I am hoping that since my payback is 100% that I can pay off my plan before 60 months. Another issue is that I owe another 4k on my 2008 taxes. I wonder if I can pay that myself each month or does it HAVE TO BE inlcuded
    in my plan?

    If you are in a 100% plan, then it is possible to pay your plan off before hitting 60 months. Discuss if this is allowed in your local court.

    Did you find out you owed the $4K extra in taxes before or after you filed your 13?

      2008 Taxes owed

      I had my taxes completed after my confirmation hearing which was on
      April 2nd. I now owe 4k, and I am paying back taxes in my current plan.

      Also I still need want to know what Pro-Tanto percent means??

        Pro-rata means "in proportion, according to a factor that can be calculated exactly"

        We don't really have any other information other than you are on a 100% plan - you would need to speak to your attorney; but, it sounds like you are paying 100% of the claim amount (whatever the claim is in your BK).

            I had never heard of the word "pro_tanto" so I looked it up:

            This term is usually used in a legal sense. For example, when a judge orders pro-tanto payment (partial fulfillment).

            Maybe HHM or one of the others can chime in how it affects your BK case....

            Found another definition that might help explain it:

            (proh tahn-toe) Latin for "only to that extent." Example: a judge gives an order for payments for one year, pro tanto.
