Because of a bi-weekley payroll deduction we have over $4,000 in the trustees account after the end of each month...and it is getting larger. Will the trustee release it or apply it to our bills? We are already at 100% payback.

Trustees don't pay your bills the same way you did. They release the money when and where they see fit. The creditors have to take what he/she releases to them when it's released.Originally posted by Maximo View PostBecause of a bi-weekley payroll deduction we have over $4,000 in the trustees account after the end of each month...and it is getting larger. At the end of your plan after your trustee completes the required audit to ensure every creditor received what they were entitled to receive, if there is anything left over, you will get that amount back at that time.
Until then, stop worrying about how your trustee is disbursing your payments. You have zero control over that. Just keep making your payments on time - the one thing you do control in your 13.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

Again, it doesn't matter how much builds up in your trustee's account or when/how much your trustee disburses payments to your creditors. Just keep making your payments on time. That's the only thing you have to worry about.Originally posted by Maximo View PostExcess is up to 8800 now!
Just curious....has your Ch 13 plan been confirmed yet?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
