    Switching from 13 to 7

    My husband is no longer working. Our attorney has put in a request for us to skip a couple of payments. He suggested to us that we consider going from Chapter 13 to 7. Our plan was originally going to be done in 26 months (this November). What paperwork is required for that? Would our car have to be involved ('99 Sable - owe $2000). The car is our main concern because his parents co-signed and our credit union will close our checking account if the car is involved (we can't get an account anywhere else). Also I want to know why the government didn't give me any money for filing bankruptcy.

    A motion would need to be filed, and your attorney will have you pay a fee, maybe $300.

    If you still owe money on the car, then you would just continue to make your payments on it.

    You should be able to find another small bank that will give you a checking account. Why would the government give you money to file a BK, you are already utilizing your rights as a consumer and deleting your debts at their expense, isnt that enough?

      I think truckerswife was joking about how the government is giving big bailouts to those corporations that are going bankrupt, like Chrysler and GM.

          lol on the being literal all the time. I was just guessing, it really is hard to tell humor/sarcasm/irony, etc in postings.

            I was being sarcastic, because of GM. And my current plan (which we prefer to stay in) we are paying back 100%. (with the exception of our house which I don't know how that is going to work). I was just wondering in case worse comes to worse and my husband is out of work for several months. Thanks for trying to help me though. It is appreciated.
