    Strange Letter

    Ok the Summons came to certified mail....Its say we need to answer to the complaint within twenty-eight days after service of this summons on you, exclusive of the day of service. You answer mus be filed with the Court within three days after service of a copy of the answer on the plaintiff's attorney.

    What does the "within three days" mean?
    Filed August 09, all payments made as of July 12th, 2013.....Waiting on final audit and discharge!

    I believe you are the one dealing with HSBC? If so, did you by chance contact your attorney? Are you filing soon? When we received our summons, I called the attorney right away. I was informed we would be fine, not to respond, we would be found to be responsible for this bill, which ofcourse we were. But with us, we had everything at the attorneys, he was paid, waiting on us. So we knew we would be filed before any action could be taken against us. The date of the hearing, we did not go, what was the point? We knew we owed the money, we also knew we would be filing any day. Alot depends on how soon will you file? Most all this can be answered by your attorney.

    So unless this is not your debt, they will win the case against you, they will then want a garnishment unless you can pay this when they win. You will have a little time. Best bet, get the ball rolling on your BK. This is the push we needed to get ours filed.

    Try not to worry too much, you probably suspected sooner or later one of them would sue.
