Converted to 7 then dismissed - ? about car

Hello!! here's my story: My husband filed Chapter 7 2002 - then together we filed 13 March 08. In June he lost his job in construction due to the economy here in OH. We converted to a 7 but he was dismissed due to not enough time elapsing from the 7 in 2002.

Here's my question: He was dismissed in May, early June 2009. The car is in his name - no one has contacted us from the loan company to come and get the car. I need this car because he has now taken employment in another state. My attorney tells me to drive it until the repo guy shows up. Has this happen to you and if so how long were you able to keep the car. I was told they have already written this car off on taxes since the original bk was in 2007. Could this be true? It's a 2004 Volvo.

don't know on the timeframe, but leave NOTHING in the car when you go to work. Repo men don't have to give any warning or let you take your personal items out of the vehicle, so be always prepared to walk out to the car and find it missing. Also, make sure you always have cabfare for the ride home just in case. Other than that, enjoy however long you end up having the car without payments, and I hope for your sake it is a good long time! In the meantime, start saving up for a cheap used car, although the Cash for Clunkers program is taking a lot of the older vehicles off the market.

In my case, we drove the vehicle for about 3 months. In your case, with your BK being dismissed, your creditors may jump on it and take it asap. There is really no telling a time frame. Where are you parking it?
