    adding car payment to plan

    Hi

    I've followed this forum for a while but could not really find an answer to my question so i decided to register and post. My husband and I filed chapter 13 October 08. We are on a 5 year plan at 100% payback, with a motorcycle and a car paid outside the plan. We recently moved from an apt to a house, and our rent is about 250 more a month. Plus my income is down a bit due to no overtime. My husband is having a lot of trouble finding a job to offset our new expenses. So this month we are probably not going to be able to make our vehicle payments very easily, with so many extra costs involved in the move. I am in the process of getting an appt with my lawyer but I am nervous and wish I had an answer now.

    Basically I want to know if we could put the car and/or the bike into the plan in order to reduce our monthly payments overall. I've read some posts that dont seem very promising about motorcycles in bankruptcy, but we are in a 100% plan so I wasnt sure. We are in FL by the way. I really am not sure why we have been paying outside the plan anyway. But I'm definitely not an expert on the whole thing.

    I would really appreciate some help!

      since your plan is confirmed it might be an issue because the payments are really post petition. But see what your attorney says.

        Well, I talked to the lawyer today, but it didnt help much. He said that it is possible to add the cars to the plan. It would require making a new budget and basically redoing the whole plan, and that the payments would go up. On top of that he quoted me 1000 dollar charge to do it. Wow. Then there is no guarantee the court will approve it. And the charge is due before he does any work. These are the best bankruptcy lawyers in our city, but their fees are ridiculous.

          well just remember you pay for what you get. If they are the best in your area, then I suspect your chances are good it will get approved. So is the 1000 worth it then to have the peace of mind and not worry about your vehicles?

            probably if i had the 1000 dollars


            but of course if i had 1000 dollars, i could pay my car payments just fine.
