Would appreciate any help. Countrywide received relief of automatic stay. They agreed not to foreclose as we were in process of re-financing. Meanwhile, our 2nd (private lender) paid arrears, $60,000 to Countrywide which shocked us. Not knowing we were refinancing, she filed foreclosure knowing we were in Chapter 13, yet did not get relief of automatic stay. She paid this 2 months ago and is now charging us 6,000 in interest for 2 months. What is userial???
Isn't there some kind of breech? We have a buyer for our home. 3rd lender (also private) refuses to give title company payoff demand, it has been 3 weeks and title company has repeatedly contacted him to no avail. Our attorney is new and says there is nothing we can do. He has finally filed for petition for approval of sale. I have been told by someone that he should file sanctions on these people. We have buyer, papers are signed and we are ready to go. Can't get our atty to fight for us.

I know this sounds complicated, reason we filed because when CW took over our loan 2 years ago. There was errors in transfer. We tried to fight it to no avail.
