    Ohio attorney wants POA

    Do I have to give my attorney POA. I filled Chap 13 and my attorney insists that I sign a POA so that she can access my tax records, she said this was because people often don't send in the tax copies to the trustee in a timely manner. The POA states she is authorized to make changes and sign documents..however it states she cannot sign any checks. I don't owe any taxes and have no existing tax problems. So why does she want this POA? I contacted the IRS and was told the POA is unnecessary and that any documents needed for a chap 13 could be provide to the attorney by me. The need for a POA is not mentioned in any paperwork from my attorney or the trustee. I need to know if I should revoke this POA, ASAP.

    Where are you located? Having POA isn't necessary.

      Dayton (Southern District of Ohio)...by the way, attorney has asked me for documents and also suggested I change my exemptions myself, which is exactly why the POA was requested (so that she could get docs...actually, the attorney really seems interested in getting & controlling my refund checks.

          heck no dont give him poa if he still insist on it get another attorney. he is wanting his money faster is what it is. if you get a refund he will request that the court take it and it gets disbursed, and guess what he gets most of his chunk first!

            It might be some local rule of the BK court there, but typically your attorney should not need a POA.

            By the way, whether your attorney has a POA or not, you will likely have to surrender your tax return anyway.
