    Oh No, I Filed Again Too Early, Now What? 😲

    So I got a lawyer, gave him the retaining fee, and began the bankruptcy process. It is filed. I still have yet to go to the court house and take my second online course. My question is this: Isn't it part of the attorney's job to find the last date there was a discharge and say "Hey, no enough time has passed since your last discharge."? Is that part of his job or is that for the court to tell me or what? Thanks so much for the input.

    Are you indicating that you filed a bankruptcy within the 8 years prior to your current case and you did not tell this to your attny? How did you answer the question on the bankruptcy Petition that asks if you have filed a prior case within the past 8 year?

    While the attny could have spent the time to do a name search off of PACER and passed that cost on to you, it was your responsibility to inform your attny of events that might impact your current case.

    Having said the above please answer the following:

    What was the filing date (not the discharge date) of the prior case?

    What chapter was the prior case?

    What chapter have you just filed?
