    341 was yesterday

    Had my 341 yesterday. Was asked the basic questions, and a few others. There were a couple of things that the trustee had questions about, but I answered them to the best of my ability. One question was to some deposit amounts in my checking, and one was my amount that I had entered for food. She asked if I felt that $800 was accurate as to my family of 5 for groceries. I answered in the affirmative.

    So...I checked on Pacer and here was the entry:

    Meeting of Creditors Held, Trustee's Report of No Distribution: Trustee of this estate reports and certifies that the trustee has performed the duties required of a trustee under 11 U.S.C. 704 and has concluded that there are no assets to administer for the benefit of creditors of this estate.I have received no funds or property of the estate, and paid no monies on account of the estate. Wherefore, the trustee prays that this report be approved and the trustee be discharged from office.

    I assume that this is good?
    Chapter 7 filed - 09/29/06
    341 Meeting - 10/30/06 (Continued until 11/30)
    DISCHARGED! - 12/30/06
    Startin' Over - 01/01/07

    Yep! That's good!

    That's pretty much the standard legaleeze for "I've reviewed everything. Found No Assets to Distribute. I wanna be released from my duties regarding this BK Case."

    Now, just kick back, prop up your feet, and hopefully, you'll have an uneventful 60 days. Then you'll be DISCHARGED!!

      Great news for you guys! I had my 341 last Thursday (30th). I also checked pacer, but nothing is there yet concerning the 341. Since yours showed up so quick should I be nervous?

        Did the Trustee ask about your Income Tax Refund for next spring, Penny??

        Ours did. He's gonna hold our Close until he sees our Income Tax returns after we file.

        Everyone else, except us and one other filer, got the note posted above. Both of us are being held over for our taxes next spring.

        The other lady filer generally gets about a $3K refund every year. Ours, we had a big return for '04 and then paid big time for '05. So the Trustee is gonna wait to see if he can squeeze some money out of either of us.

          No, the trustee did not say he wanted the tax refund. I filed without husband and he is the sole wage earner. trustee just asked if he made all the household income -as he was looking at last year's refund which was big. Then he just said thank you, you are done.
