    I am the dumbest person on this board

    Of all the stupid things I have done in my life, this one takes the cake. I am soooooooooooooooooooooooo stupid. You would think that I should of known better since i have been reading these boards for a few months now. My lawyer called me yesterday and informed me that the reaffirmations didnt get filed in time. I was reaffirming my first and second mortgage and my car for the the incredible deal of 750.00. So now I owe this money to my lawyer for nothing. I do take the blame for the car and second mortgage,but she didnt have the first mortgage paper ready untill the 7th and I discharged around the 12th. She says they can default on me now if they want to. So what do you guys think? Can I lose my house now? I dont see how they can when my husband is also on the mortgage and he didnt file. What do you guys think?

      Technically,.................. The short answer is Yes.

      The New Law did not allow for "Ride Thru" so the Lenders would surely be within their rights to force you to Redeem or Surrender.

      Redeem,.......... You'd get new loans to pay your existing Lenders in full. If you can. Keep the house and car.

      Surrender,.............. Well that's obvious.

      But more than likely what will happen is, your Lenders will continue taking your payments. Getting money from you, on a regular basis, every month, is easier and cheaper for the Lenders than the alternatives. Foreclosure and Repossession.

      I would caution you to ALWAYS be prompt with your payments. I wouldn't even hedge into the grace periods if these were my loans. Stay under the Lenders' radars.

      If you're ever gonna have a problem making a payment, contact the Lender ASAP. Don't give either one of these Lenders an opportunity to bat an eyelash in your direction.

      In your favor, if you ever have a problem down the road,......... You can voluntarily surrender the car to free up that money/month. You can walk away from the house and not look back.
