    Bank never completed their paperwork!?

    We filed chap 7 in Oct. had 3 vehicles. We were going to let the banks take them back, did not list them as exemptions. 1st bank came right away and took vehicle. Nobody ever showed up to get the other 2. I took out the titles for them and was looking it over - when we took out the loans on the other 2 (did it at the same time) the bank never took the title and got put as a leinholder! I have the titles and they are not listed on them. What's this mean? They dont have the right to repo? my case has not been discharged yet, waiting on a slow trustee. Any opinions?

    If you had a loan against the autos and the lien holder (bank) was not listed on the title paper............... they don't have a lien on it................. You own it free and clear.....

    It's called an "unperfected title".........

    Also this puts the auto in the position for the Trustee to take it and sell it if nothing is owed against it and you have not exempted it........ It's known as a free and clear asset.
