    Hello,


    I am in the process of doing my paper work for Chapter 7... i pulled my credit report and i saw i had 3 state tax liens for about a total of 800.00 and one judgment for 2500.00... not sure what the liens are for but i know the judgement is for a apartment i had 3 years ago... wanted to know if theses can be listed on my bankruptcy.... Also on my credit report it has that a owe someone 41.00 but does list who just has the amount and the date which is from 2002 thanks..

      Yes, you must list all debts on your bankruptcy. The real question, however, is will the debts be discharged. That is too hard to answer. Odds are, YES, but given that these are state tax liens, I don't know for sure.

        State taxes cannot be erased or discharged in bankruptcy. Federal taxes (with some exclusions and limits) CAN be discharged, but pls seek a tax pro's advice/assistance with that. The debt underlying the judgement can be erased (but not the judgment - you'll have to have that vacated after the debt is discharged)...in other words, the judgement becomes unenforceable. Get a paper copy of the credit report - not online - that should identify the creditor for the $41 debt. If not, have it removed or verified and ask them to provide the name of the creditor.
