    Will Landlord be notified??

    I leased my duplex in November after my attorney said it was ok to move into an apartment because my house, which is in foreclosure, is being surrendered in my BK, and I felt it would be easier to find a place before I filed. Anyway..i am curious, will the bankruptcy court notify my new landlord that I have filed bk? I am not behind in my rent so there are no claims for this new residence on my petition.

    Nope. Shouldn't be.

    Your lease and your Landlord and the landlord's contact info will be listed in your BK Petition.

    SCHEDULE G. EXECUTORY CONTRACTS AND UNEXPIRED LEASES

    But your Landlord should not receive a notice of your BK filing.

      But even if your landlord does find out, it probably won't matter.

        I have seen clause in rental agreement that says you have to inform them of any change in your financial situation within the first 90 days of signing the lease. They would terminate the lease and make you sign a new one with a cosigner....

        Hope that is not the case with your lease.

          Thankyou all. I read over my lease and there is no clause in it stating i have to inform them of any financial changes. I make sure my rent is paid on time before any other bills, and according to my neighbor, they LOVE us here! Apparently, the last tenants left MUCH to be desired..lol. So, I think I should be ok. I was hoping the court wouldn't send any notification out to them. I know bk information is open to the public, but, I didn't want to 'advertise' it unnecessarily.

            My lawyer put my landlord on Schedule G and on the matrix. I knew they would be notified, so I talked to them and made sure they knew I wanted to keep the lease. It was not a problem.

            I've since moved, so I'm still waiting on them to figure the charges for wear beyond the proverbial "normal wear and tear" and get me my deposit back.
