    Discharge date?

    File date 11/9/06 (was supposed to be end of Sept, but our 1st atty was fired)

    1st --341 meeting was 12/12/06 (1st atty didn't send a few documents in so my husband had to go back 2 wks. later)

    2nd --341 meeting was 12/28; all clear & overwith

    Last date of objections is 2/12/07 (they kept the original date/2 mos. from first 341 meeting)...that shouldn't change, right? Atty's secretary verified that's what she had.

    We did get a call back from the atty. recently and one of his questions was if we took the 2nd and final online course, which we did, and he said he had to make sure it was uploaded. But on the PACER website, it showed it was uploaded and received on 11/27---so we should be okay, right? I would have thought that the trustee would have said something on 12/28 if all info wasn't in, even if they do allow up until 45 days after the 341 to complete the online course.

    So my question is, what do you think our discharge date will be? Atty's secretary predicted 1-2 wks. after 2/12, which is the last date of objections. BUT do we add 2 wks. onto that because of the continuance? As our atty put it, ch. 7's are pretty mechanical and he does not forsee any issues for us. No asset is mentioned on the PACER website.

    Should I start checking it after 2/9 (which is 90 days from filing)? Is it possible to be discharged on or before 2/9? Do we have to allow for 60 days from the 341 meeting? Confusing w/ the continuance. We just want this to be overwith.

    By statute, the discharge is supposed to occur 60 days from the "first scheduled" date of your 341 meeting. But depending on how the court operates in your area, it may take a little longer for practical reasons. However, if your court has automated the discharge process, it will probably occur within a week of the objection deadline.
