It does, but I think the prevailing thought on that is that provision is a violation of free speech and probably unconstitutional, so no one really enforces it. (although, I don't know if any cases have come down on that issue yet, because no one has made an issue of it).

I know the one we talked to gave similar advice about borrowing against the equity in our house. Though he was kind of vague and hinting about it. Like he didn't want to come right out and say it.

Actually it is. If my 7 is dismissed, then its back to where I was before - in Texas essentially judgement-proof. There are a lot of unpleasantries associated with that though since bad credit will go on and on as I slowly work off all that debt over probably many years. I don't have any assets that need to be protected in a 13, so what would be the point? Well, I will know for sure on the 29th how it looks. I have a good attorney who has been doing BK's in Texas a long time. When I do the online means test, I come up with about $30 in disposable income each month - and that is without digging much. On Schedules I and J, it isn't even close. The lady from CCCS said Ch 7 looked like my only option.
