    dell anyone?

    Using the search function I have found many threads where people are getting ready to file or have just filed and asking about dell and if they will come after them for the computer. But can't find where anyone has ever come back to update the situation!

    We are going to see a lawyer this week and hopefully will file within the month. I have a dell laptop on a preferred dell account. I also made some other smaller purchases with it, ink cartridges, headset etc. Laptop was about 1900-2000 when I bought it. I did'nt realize it was secured or I never would've stopped paying on it. It is in collections now and up to almost 3500. There is no way I am going to reaffirm at 3500 for a 1 year old computer.

    I had no way to anticipate we would file when I bought it as my husband was in an accident and for now is unable to work. I am an independant contractor and have to have a computer to be able to work. So if dell if going to want the laptop back I need to start working on a plan to get another one or we will loose ALL of our income!

    Jal, from other filers' experiences they have shared, it is unlikely that Dell would come knocking at your door to pick up the computer. They want your money, not the merchandise. They won't make back $3,500 if they have to pay someone to enforce the contract and then sell your computer as a refurbished model. Of course Dell will threaten to try to get you to pay, but in the long run, you will likely keep your computer.

    Be sure to add this to the list of questions to ask the lawyer when you see him/her - they may have other clients who have had to deal with Dell. Also would encourage you to make free appointments for consultations with 2-3 other bk lawyers in your area as well. Each time you talk with a bk attorney, you can discover new information and interpretations, plus you'll be able to compare the lawyers to see which one you feel will do the best job representing you.
