I am planning on filing ch.7 fairly soon. I have already received my tax refund and have put the money in the bank to pay some of our bills. I also put some away in a savings account. Is this going to be taken or will it just be added into our assets? It is about $2000 all together.

KM is right. Any money beyond what is considered acceptable in your bankruptcy district could be at risk if you can't cover the total amount in both of your accounts using an exemption on the day you file. If your state doesn't have an exemption you can use to cover the amounts in your checking and savings account on filing day, then your goal is to have as little as possible in both accounts on filing day. What state will you be filing in? When are you planning to file?Originally posted by keepmine View PostYou need to know how much cash your state allows a an exemption.
If you are filing with a lawyer, then he/she can help you sort out what your best options are under the circumstances. Are you filing with a lawyer?Last edited by lrprn; 02-25-2007, 03:10 PM.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

Lucky you...in California you get to choose between two exemption systems and pick the one that works best for your case. See http://www.bankruptcyaction.com/caexemptions.htm for a listing of what is allowed in each system.Originally posted by manglicmot View PostWhere can I find the exemption for California? Here are your exemptions for RI, plus you can choose to use the federal exemptions instead if those work out better in your case - http://www.bankruptcyaction.com/riexemptions.htmOriginally posted by patience View PostI am in Rhode Island.
