    what does this mean in English?

    someone, Please explain this in plain English? Is this routine to hire the trustee as attorney if assests were found?


    Title of the first letter recieved in mail:

    APPLICATION BY TRUSTEE AND LAW FIRM OF WHICH TRUSTEE IS A MEMBER TO ACT AS AN ATTORNEY FOR THE ESTATE

    What does this mean as well:

    It is in the best interest of this estate & its econmomical administration that your appicant and her law firm, be authorized to act as counsel for the trustee in this estate to proceed with the complaint of revocation of the debtors dischage. It is the applicants belief that the cost of the estate would be less than if outside counsel were retained.


    What does this mean:

    MOTION TO WITHDRAW TURNOVER MOTION

    The trustee prays that her motion for turnover be withdrawn and for such other or further relief as the Court may direct under the premises.


    Please help us with advice asap!

    Generally, whenever a case is more involved than routine, straightforward, No Asset case,......... The Trustee will hire legal counsel to represent them in the matter. Lots of times, the Trustee hires themselves as their own attny. It's just another way for the Trustee to get more money out of the deal.

    It is not at all uncommon.

    Basically the Court is saying the Trustee is charging your BK Estate less money than an outside attny would to perform the same services.

    As to the last part,............

    Evidently the Trustee filed a Motion for Turnover. And now the Trustee is asking the Court to withdraw that original Motion.

      Thanks for replying Sinkingfast- exactly what I am afraid of here.

      Yeah, that is what I am really worried about- in April she asked us to turn over assests and agreed to a repayment plan- her payment plan of 652.00 per month paid back each mo for 9months- not our plan originally offered and agreed to over the phone. Now at the end of April she is asking to revoke that motion. What does this mean? Will she be the attorney for our case- shows $200 per hour and $60 per hour for paraleagal fees. Ask for a revoke of our discharge?

      CONFUSED and SCARED!
